Welcome to Irosk Australia. The terms "we", "us" and "our" refer to
Irosk Australia. We operate this store and website, including all
related information, content, features, tools, products and services
in order to provide you, the customer, with a curated shopping
experience (the "Services"). Irosk Australia is powered by Shopify,
which enables us to provide the Services to you.
These terms and conditions, together with any policies referenced
here (these "Terms of Service" or "Terms"), describe your rights and
responsibilities when you use the Services. Please read them
carefully, as they include important information about your legal
rights.
By visiting, interacting with or using our Services, you agree to be
bound by these Terms of Service and our Privacy Policy. If you do not
agree, you should not use or access our Services.
YOUR RIGHTS UNDER AUSTRALIAN CONSUMER LAW
Our goods come with guarantees that cannot be excluded under the
Australian Consumer Law. You are entitled to a replacement or refund
for a major failure and to compensation for any other reasonably
foreseeable loss or damage. You are also entitled to have the goods
repaired or replaced if they fail to be of acceptable quality and the
failure does not amount to a major failure.
Nothing in these Terms excludes, restricts or modifies any guarantee,
right or remedy you have under the Australian Consumer Law or any
other law that cannot be excluded or limited by agreement. Where any
provision of these Terms would have that effect, it does not apply to
you. If you are purchasing from outside Australia, nothing in these
Terms limits any rights you have under the consumer law of your own
country.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms, you represent that you are at least the
age of majority in your state or territory of residence, and that you
have given us consent to allow any of your minor dependants to use
the Services on devices you own, purchase or manage.
To use the Services, including browsing our online store or
purchasing products, you may be asked to provide certain information,
such as your email address and billing, payment and shipping details.
You represent that all information you provide is correct, current
and complete, and that you have all rights necessary to provide it.
You are responsible for maintaining the security of your account
credentials and for your account activity. You may not transfer,
sell, assign or licence your account to any other person.
SECTION 2 - OUR PRODUCTS
We make every effort to represent our products accurately. Please
note that colours and product appearance may differ from how they
appear on your screen, depending on your device and its settings.
Each piece is handcrafted, so small natural variations between
individual pieces are normal.
Descriptions of products may change at any time without notice. We
may discontinue any product at any time and may limit the quantities
we offer to any person, region or jurisdiction on a case-by-case
basis.
Nothing in this section affects the consumer guarantees that apply to
our products, including the guarantees that goods are of acceptable
quality and match their description.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. We may
accept or decline your order at our discretion. Your order is not
accepted until we confirm acceptance, and we must receive and process
your payment before an order is accepted.
Please review your order carefully before submitting it, as we may be
unable to accommodate cancellation requests once an order has been
accepted and dispatched. If you need to change or cancel an order,
contact us at support@irosk.com.au as soon as possible and we will do
our best to help if the order has not yet shipped.
If we do not accept, change or cancel an order, we will attempt to
notify you using the email address, billing address or phone number
provided at the time of the order, and will refund any amount you
have paid in full.
Your purchases are subject to return or exchange in accordance with
our Returns & Refunds Policy.
You represent that your purchases are for your own personal or
household use and not for commercial resale.
SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions are subject to change without
notice. The price charged will be the price in effect at the time
your order is placed, as set out in your order confirmation email.
All prices are in Australian dollars unless otherwise shown at
checkout. Unless expressly stated, posted prices do not include
shipping, handling, or any customs or import charges applying in
destinations outside Australia and New Zealand.
Prices in our online store may differ from prices offered at markets,
pop-up shops or in-person events. We may run promotions governed by
their own terms; where those terms conflict with these Terms, the
promotion terms govern.
You agree to provide current, complete and accurate purchase, payment
and account information, and to keep it up to date so that we can
complete your transactions and contact you as needed.
You represent that the payment information you provide is true and
complete, that you are authorised to use the payment method, and that
you will pay the charges incurred at the posted prices, including
shipping and any applicable taxes.
SECTION 5 - SHIPPING AND DELIVERY
Delivery terms are set out in our Shipping Policy.
Delivery times quoted by us and by our carriers are estimates, not
guarantees, and can be affected by carrier delays, customs processing
and events outside our control. We will keep you informed and help
resolve any delivery problem.
Risk of loss passes to you on delivery. If your order does not arrive,
arrives damaged, or is marked delivered but missing, contact us at
support@irosk.com.au and we will investigate with the carrier and make
it right in accordance with our Returns & Refunds Policy and your
rights under the Australian Consumer Law.
SECTION 6 - INTELLECTUAL PROPERTY
Our Services, including all trademarks, brands, text, displays,
images, graphics, product reviews, video and audio, and the design,
selection and arrangement of them, are owned by Irosk Australia, its
affiliates or licensors, and are protected by Australian and
international intellectual property laws.
These Terms permit you to use the Services for your personal,
non-commercial use only. You must not reproduce, distribute, modify,
create derivative works of, publicly display, republish, download,
store or transmit any material on the Services without our prior
written consent. Except as expressly provided here, nothing in these
Terms grants you a licence under any patent, trademark, copyright or
other intellectual property of Irosk Australia, Shopify or any third
party. All rights not expressly granted are reserved.
Irosk Australia's names, logos, product names, designs and slogans
are trademarks of Irosk Australia or its licensors and must not be
used without our prior written permission. Shopify's name, logo,
product and service names, designs and slogans are trademarks of
Shopify. All other marks on the Services belong to their respective
owners.
SECTION 7 - OPTIONAL TOOLS
You may be given access to tools offered by third parties as part of
the Services, which we neither monitor nor control.
We provide access to such tools on an "as is" and "as available"
basis, without endorsement. Your use of optional third-party tools is
at your own risk and discretion, and you should ensure you are
familiar with and accept the terms on which those tools are provided.
We may offer new features through the Services in future. Those
features form part of the Services and are subject to these Terms.
SECTION 8 - THIRD-PARTY LINKS
The Services may contain materials and links to websites provided or
operated by third parties, including embedded third-party
functionality. We are not responsible for examining or evaluating the
content or accuracy of third-party materials or websites. If you
leave the Services to access them, you do so at your own risk.
Please review the third party's policies and practices before
engaging in any transaction with them. Complaints, claims or
questions about third-party products and services should be directed
to that third party.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
Irosk Australia is powered by Shopify, which enables us to provide the
Services to you. However, any sales and purchases you make in our
store are made directly with Irosk Australia. By using the Services,
you acknowledge and agree that Shopify is not responsible for any
aspect of any sales between you and Irosk Australia, including any
injury, damage or loss resulting from purchased products and
services. You expressly release Shopify and its affiliates from all
claims, damages and liabilities arising from or related to your
purchases and transactions with Irosk Australia.
SECTION 10 - PRIVACY
All personal information we collect through the Services is subject
to our Privacy Policy, and certain personal information may be
subject to Shopify's Privacy Policy. By using the Services, you
acknowledge that you have read these policies.
Because the Services are hosted by Shopify, Shopify collects and
processes personal information about your access to and use of the
Services in order to provide and improve them. Information you submit
will be transmitted to and shared with Shopify and with third parties
that may be located in countries other than where you reside, in
order to provide services to you. See our Privacy Policy for details.
SECTION 11 - FEEDBACK AND REVIEWS
If you submit, upload, post, email or otherwise transmit any ideas,
suggestions, feedback, reviews, proposals or other content
("Feedback"), you grant us a perpetual, worldwide, sublicensable,
royalty-free licence to use, reproduce, modify, publish, distribute
and display that Feedback in any medium for any purpose, including
commercial use.
You represent that you own or have all necessary rights to the
Feedback, that you have disclosed any compensation or incentive
received in connection with it, and that it complies with these
Terms. We are under no obligation to keep Feedback confidential, to
pay compensation for it, or to respond to it.
We may, but need not, monitor, edit or remove Feedback we consider
unlawful, offensive, defamatory, obscene or otherwise objectionable,
or that infringes any party's rights or these Terms.
You agree your Feedback will not violate any third-party right,
contain unlawful or abusive material, or contain any virus or
malware. You may not use a false email address or misrepresent the
origin of any Feedback. You are responsible for your Feedback and its
accuracy.
SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally information in the Services may contain typographical
errors, inaccuracies or omissions relating to product descriptions,
pricing, promotions, shipping charges, transit times or availability.
We reserve the right to correct any error and to change or update
information at any time without prior notice. Where a product has
been listed at an obviously incorrect price, we will contact you
before dispatch and you may either confirm the corrected price or
cancel the order for a full refund. We will not charge you more than
the price you agreed to at checkout without your consent.
SECTION 13 - PROHIBITED USES
You may access and use the Services for lawful purposes only. You may
not use the Services, directly or indirectly: (a) for any unlawful or
malicious purpose; (b) to breach any law or regulation; (c) to
infringe our intellectual property rights or those of others; (d) to
harass, abuse, insult, harm, defame, disparage or intimidate our
employees or any other person; (e) to transmit false or misleading
information; (f) to use or re-use any material in a way that does not
comply with these Terms; (g) to send advertising or promotional
material, junk mail, chain letters or spam; (h) to impersonate any
other person or entity; or (i) to engage in conduct that restricts or
inhibits anyone's use or enjoyment of the Services, or that may harm
Irosk Australia, Shopify or users of the Services.
You also agree not to: (a) upload or transmit viruses or malicious
code; (b) reproduce, duplicate, copy, extract, sell, resell or exploit
any portion of the Services; (c) collect or track the personal
information of others; (d) spam, phish, pharm or pretext the
Services; (e) use any robot, spider, scraping or data-extraction
tool, AI agent or automated means to access the Services; or (f)
interfere with, bypass or circumvent our security measures, robot
exclusion headers or access restrictions.
We may suspend, disable or terminate your account if we determine
that you have breached these Terms.
SECTION 14 - AGENTS
14.1 This section applies if you use, allow, enable or cause the
deployment of an Agent to access, use or interact with any Services.
"Agent" means any software or service that takes autonomous or
semi-autonomous action on behalf of, or at the instruction of, any
person or entity, and that can be executed without direct
supervision.
14.2 No Agent may access, use or interact with the Services unless it
identifies itself and operates in accordance with section 14.4 at all
times. No Agent may access the Services if we have asked it to
refrain from doing so.
14.3 We may limit, including by technical measures, whether and how
any Agent accesses, uses and interacts with the Services.
14.4 Agents must: (i) identify in all HTTP/HTTPS requests that the
request is from an Agent, and disclose the Agent's name in the user
agent string in the form "Agent/[agent name]"; (ii) not conceal or
obfuscate that access or interaction is from an Agent, including by
mimicking human behaviour or by completing or circumventing CAPTCHAs
or similar measures; (iii) respond truthfully to any prompt seeking
to determine whether interactions come from a human or a computer;
and (iv) not circumvent any measure intended to block, limit or
control how Agents access the Services.
SECTION 15 - OUR AI ASSISTANT
Our website provides an AI chat assistant and AI-generated product
recommendations.
The assistant provides general information only. It cannot approve
returns, warranty claims or refunds, change or cancel orders, access
your order or account details, or confirm a delivery date for a
specific order. Any information it gives about our policies is a
summary. Where anything the assistant says differs from our published
Returns & Refunds Policy, Shipping Policy or these Terms, the
published policies apply.
For anything affecting your order, please contact us directly at
support@irosk.com.au. Nothing in this section limits your rights
under the Australian Consumer Law.
SECTION 16 - TERMINATION
We may terminate this agreement or your access to the Services in our
discretion at any time, and you will remain liable for all amounts
due up to and including the date of termination.
The following sections continue to apply after termination:
Intellectual Property, Feedback and Reviews, Termination, Disclaimer,
Limitation of Liability, Indemnification, Severability, Waiver and
Entire Agreement, Assignment, Governing Law and Privacy, together
with any other provisions that by their nature should survive.
SECTION 17 - DISCLAIMER
Information presented on or through the Services is made available
for general information purposes. We do not warrant that general
information on the site is complete or suitable for your particular
circumstances, and any reliance you place on it is at your own risk.
Subject to your rights under the Australian Consumer Law, and to the
extent permitted by law, the Services are provided on an "as is" and
"as available" basis, and we do not guarantee that your use of the
Services will be uninterrupted, timely, secure or error-free.
Nothing in this section excludes, restricts or modifies any consumer
guarantee that applies to goods or services we supply to you,
including the guarantees as to acceptable quality, fitness for a
disclosed purpose, correspondence with description, and due care and
skill.
SECTION 18 - LIMITATION OF LIABILITY
Nothing in this section excludes, restricts or modifies any guarantee,
right or remedy you have under the Australian Consumer Law or any
other law that cannot be excluded.
Where we are liable for a failure to comply with a consumer guarantee
in relation to goods, and that failure is not a major failure, our
liability is limited, at our option, to replacing the goods,
supplying equivalent goods, repairing the goods, or paying the cost
of replacing or repairing the goods.
Subject to the above, and to the extent permitted by law, we are not
liable for indirect, incidental, special or consequential loss,
including lost profits, lost revenue, lost savings or loss of data,
arising from your use of the Services or of any product purchased
through them.
SECTION 19 - INDEMNIFICATION
You agree to indemnify Irosk Australia, Shopify and our affiliates,
officers, directors, employees, agents, contractors, licensors and
service providers against any loss, damage, liability or claim,
including reasonable legal costs, payable to a third party and
arising out of (1) your breach of these Terms, (2) your breach of any
law or of a third party's rights, or (3) your access to and use of
the Services.
This indemnity does not apply to the extent that the loss or claim is
caused or contributed to by our own act, omission or negligence.
We will notify you of any indemnifiable claim, although a failure to
notify promptly will not relieve you of your obligations unless you
are materially prejudiced. We may control the defence and settlement
of such a claim at your expense, but will not settle any claim
requiring non-monetary obligations from you without your consent,
which must not be unreasonably withheld. You will cooperate in the
defence of indemnified claims.
SECTION 20 - SEVERABILITY
If any provision of these Terms is determined to be unlawful, void or
unenforceable, that provision is nonetheless enforceable to the
fullest extent permitted by law, and the unenforceable portion is
severed. This does not affect the validity and enforceability of the
remaining provisions.
SECTION 21 - WAIVER AND ENTIRE AGREEMENT
Our failure to exercise or enforce any right or provision of these
Terms is not a waiver of that right or provision.
These Terms, together with any policies posted by us on this site,
constitute the entire agreement between you and us and govern your
use of the Services, superseding any prior agreements,
communications and proposals, whether oral or written, including any
prior versions of these Terms.
Any ambiguity in the interpretation of these Terms will not be
construed against the drafting party.
SECTION 22 - ASSIGNMENT
You may not delegate, transfer or assign these Terms or any of your
rights or obligations under them without our prior written consent,
and any attempt to do so is void. We may transfer, assign or delegate
these Terms and our rights and obligations without your consent.
SECTION 23 - GOVERNING LAW
These Terms are governed by the laws of Queensland, Australia, and
you and Irosk Australia submit to the non-exclusive jurisdiction of
the courts of Queensland. This does not limit any rights you have
under the Australian Consumer Law or, if you are purchasing from
outside Australia, under the consumer law of your own country.
Before commencing any claim, we ask that you contact us at
support@irosk.com.au so that we can try to resolve the matter
directly.
SECTION 24 - HEADINGS
Headings are included for convenience only and do not limit or
otherwise affect these Terms.
SECTION 25 - CHANGES TO THESE TERMS
You can review the most current version of these Terms at any time on
this page. We may update, change or replace any part of these Terms
by posting updates to our website, and it is your responsibility to
check periodically for changes. We will notify you of material
changes in accordance with applicable law. The version of these Terms
that applies to your order is the version published when you placed
it.
